1. Agreement to Terms

By accessing or using the RELYNQ platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.

2. Eligibility

To use RELYNQ, you must be at least 18 years old and capable of forming legally binding contracts. By registering, you represent that you meet these eligibility requirements. Users must complete our verification (KYC) process before they can rent or list items.

3. User Accounts

You are responsible for safeguarding your account credentials. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are liable for all activities conducted under your account.

4. The RELYNQ Marketplace

RELYNQ is a peer-to-peer marketplace connecting people who have items to rent ("Providers") with people seeking to rent items ("Renters"). We do not own, create, sell, resell, provide, or control any of the items listed. We are not a party to the rental agreements entered into directly between Providers and Renters.

5. Provider Responsibilities

• Accuracy: Providers must accurately describe items, including their current condition, and upload representative photos.
• Safety: Items listed must be safe to use, properly maintained, and legally owned by the Provider.
• Availability: Providers must keep their calendar up to date and honor accepted bookings.
• Pre-Rental Condition Report: Providers are required to submit a condition report before handing over the item to ensure protection against damage claims.

6. Renter Responsibilities

• Care of Items: Renters must use the item carefully, strictly according to the Provider's instructions, and return it in the exact condition it was received (fair wear and tear excepted).
• Timely Return: Items must be returned at the agreed-upon time and location. Late returns may incur severe penalties.
• Security Deposits: Renters agree that security deposits may be held or charged for damages, late returns, or other violations of the rental agreement.

7. Payments & Escrow

All payments are processed securely via our third-party provider, Razorpay. Rental fees and security deposits are held in escrow. Payouts to Providers are processed only after a successful rental period and successful return of the item. Any attempt to bypass the platform's payment system is a strict violation of these Terms and will result in immediate account termination.

8. Cancellations and Refunds

Cancellations are governed by the specific cancellation policy selected by the Provider for each listing. Refunds will be processed according to that policy. Platform service fees may be non-refundable.

9. Damages and Disputes

In the event of damage, the Renter is liable up to the full replacement value of the item. RELYNQ provides a Dispute Resolution Center to mediate claims. Both parties agree to cooperate fully and provide necessary documentation (photos, condition reports) during a dispute. Relynq's decision on dispute resolution is final.

10. Prohibited Activities

Users may not:

• List illegal, stolen, or strictly prohibited items (e.g., weapons, hazardous materials).
• Use the platform for any fraudulent or illegal activity.
• Harass, threaten, or discriminate against other users.
• Attempt to circumvent the platform's fee structure or payment systems.

11. Limitation of Liability

To the maximum extent permitted by law, RELYNQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your access to or use of the Platform.

12. Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Platform, us, or third parties, or for any other reason.
